1. Who runs this

Horowhenua Directoryis a local business directory for Levin and the Horowhenua, operated from Levin, New Zealand. In these terms “the directory” means this website, and “I” or “we” means its operator. You can reach me at hello@horowhenuadirectory.co.nz.

By using the directory, or by having a listing on it, you accept these terms.

2. What the directory is

It is an index of businesses operating in the Horowhenua. A listing is not a recommendation, an endorsement, a review, or a check that a business is licensed, insured or any good. Anything you arrange with a business you found here is between you and them, and I am not a party to it.

3. Accuracy

Listing details come from information the business has published publicly, or from what the business has told me. Details go out of date. Phone numbers change, businesses close, and opening hours move. Check with the business directly before you rely on anything here.

Where a rating is shown it is a snapshot taken on the date displayed next to it, not a live figure, and it is not mine.

If something about your business is wrong, tell me and I will fix it.

4. Adding or claiming a listing

When you add or claim a listing you are confirming that you own that business or are authorised to act for it, and that what you have given me is accurate. I may edit, decline or remove any listing, including for inaccuracy, or where the business is not in the Horowhenua.

You keep ownership of any text, logo or photo you give me. By supplying it you allow me to display it on the directory for as long as your listing is up.

Do not supply anything you do not have the rights to, anything misleading, or anything unlawful.

5. Removing a listing

If you do not want your business listed, ask and I will remove it. No questions, and no reason needed. Use the form on the privacy page or just email me. Removal of a paid listing is covered in section 7.

6. Free listings

A free listing costs nothing and carries no obligation. There is no guarantee it will appear in any particular position, or that it will bring you any enquiries.

7. Paid listings

A premium listing is $830 per year. A founding member place is $249 per year and that rate stays fixed for as long as you remain a member. Prices are in New Zealand dollars.

Paid listings are invoiced by email and run for twelve months from the date payment is received. There is no lock-in contract and nothing renews automatically: when the twelve months is up I will ask you whether you want to continue, and if you do nothing the listing reverts to a free listing.

What you are buying is placement and presentation on this directory: a position at the top of the home page and of your category, a Featured badge, and the extras listed on the premium page. It is not a guarantee of enquiries, sales, or any particular result, and it has no effect on how you rank in Google or any other search engine.

If a premium listing is not doing anything for you, tell me. I will stop it and refund the unused part of the year, worked out by whole months remaining.

Founding member places are limited to 10 and to one business per industry. If your industry is already taken I will tell you before you pay anything.

8. Using the site

Please do not scrape the directory, copy it wholesale, use it to build a competing list, or use the contact details on it to send bulk marketing. The business details here are published so locals can get in touch with a local business, not so anyone can harvest a mailing list.

9. Availability

I will keep the directory running and up to date as best I can, but it is a small local site run by one person. It may be unavailable at times, and I do not promise uninterrupted access.

10. Liability

Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where those Acts apply to you.

Where you are acquiring a paid listing for the purposes of a business, you agree that the Consumer Guarantees Act does not apply, as permitted by section 43 of that Act.

Beyond that, and to the extent the law allows, I am not liable for indirect or consequential loss, including lost profits or lost business, arising from your use of the directory or from a listing. Where liability cannot be excluded, it is limited to the amount you have paid me in the twelve months before the claim.

11. Privacy

What I collect and why is set out on the privacy page. I do not sell your information.

12. Changes

I may update these terms. The date at the top shows when they last changed. If a change materially affects a paid listing you already hold, the terms you agreed to when you paid continue to apply for the rest of that twelve months.

13. Law

These terms are governed by New Zealand law and the New Zealand courts have exclusive jurisdiction.
